These Terms and Conditions (hereinafter “Terms”) govern your access to and use of Cortex (the “Service”). Your contractual partner is KODO TECH SARL, 20 Montée de Chané, Bat. 10, 38090 Villefontaine, France (hereinafter “Kodo”, “we”, or “us”). By using the Service, you agree to these Terms.

1. Description of the Service

1.1 Cortex is a Software-as-a-Service (SaaS) platform that enables users to model systems, generate architecture views, environment definitions, and deployment artifacts from a single source of truth.

1.2 The Service is provided as an experimental alpha version and may evolve at any time.

2. Registration and Account

2.1 Cortex is accessible via open signup. You must provide accurate and complete information.

2.2 You are responsible for maintaining the confidentiality of your credentials and for all activities under your account.

3. Alpha Disclaimer

3.1 Cortex is an experimental product. The Service may contain bugs, errors, or interruptions.

3.2 Features may change, be removed, or stop working at any time.

3.3 The Service may experience downtime or data loss.

3.4 No uptime guarantee or service level agreement (SLA) is provided.

3.5 You use the Service entirely at your own risk.

4. Pricing

4.1 During the alpha phase, Pro features may be provided free of charge.

4.2 Kodo reserves the right to introduce paid plans, modify features, or transition users or organizations to paid subscriptions at any time.

4.3 Users will be informed before any billing begins.

5. Acceptable Use

5.1 You agree not to reverse engineer or attempt to extract source code, resell or sublicense access to the Service, abuse infrastructure or exceed reasonable usage, or use the Service for illegal or unauthorized purposes.

5.2 Kodo reserves the right to apply rate limits and enforce fair usage policies.

6. Outputs and Responsibility

6.1 Cortex generates architecture, configuration, and deployment outputs for assistance purposes only.

6.2 Outputs may be incomplete, incorrect, or unsafe.

6.3 You are solely responsible for validating outputs and making deployment decisions.

6.4 Kodo does not guarantee correctness, reliability, or fitness for purpose.

6.5 If you do not wish to assume this risk at your own expense, we recommend using a dedicated on-premise or enterprise solution.

7. Data and Security

7.1 We store system models and configuration data. We do not intend to store secrets.

7.2 If you submit sensitive data or secrets, you do so at your own responsibility.

7.3 You retain ownership of your data and may request deletion at any time.

7.4 Kodo may use data to operate, improve, and analyze the Service, including through anonymized or aggregated data.

8. Feedback

Any feedback, suggestions, or ideas you provide may be used freely by Kodo without restriction or compensation.

9. Confidentiality

9.1 As Cortex is an early-stage product, you agree not to disclose non-public information regarding the Service.

9.2 This obligation does not apply to publicly available or independently developed information.

10. Availability

The Service is provided without any guarantee of availability, performance, or uptime. Kodo may modify, suspend, or discontinue the Service at any time.

11. Termination

11.1 You may stop using the Service at any time and request deletion of your account and data.

11.2 Kodo may suspend or terminate your account at any time, without notice, and delete associated data.

12. Liability

12.1 The Service is provided “as is” and “as available” without warranties of any kind.

12.2 Kodo shall not be liable for indirect, incidental, or consequential damages, including loss of data, revenue, or business.

12.3 Kodo shall not be liable for damages resulting from the use of generated outputs.

12.4 Total liability is limited to the amount paid by the user in the last 12 months, if any.

13. Changes to the Terms

Kodo reserves the right to modify these Terms at any time. Continued use of the Service constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of France.
